What the fee covers

Reviewing your claim

We organize the facts and records about your final paycheck and assess whether we can help.

Pursuing payment

We handle employer communications, demands and negotiation within the service described in your agreement.

Keeping you informed

You provide the facts and requested records. We keep you updated as your claim progresses.

This service does not include representing you at a state hearing or in court. Personal legal representation outside this service would be a separate decision.

How would you like to claim?

Do it yourself, use CheckLate or hire a lawyer. Compare the cost and the work each option covers.

Do it yourself

Free to file with the state

  • You prepare the claim and organize your records.
  • You handle the forms, deadlines and follow-up yourself.
  • No CheckLate percentage is deducted.
  • You can seek payment directly or file with the California Labor Commissioner.

Hire a lawyer

Fees depend on your agreement

  • You choose a lawyer to represent you personally.
  • The lawyer handles the work you hire them to do.
  • Ask about fees, expenses and what you would owe if nothing is recovered.
  • Agree directly with the lawyer on the services and fees you need.

A separate choice, with its own agreement and fees.

No option guarantees a recovery. Filing yourself, using CheckLate and hiring a lawyer involve different responsibilities and services.

How claiming with CheckLate works

Do I pay anything to get started?

No. The initial review is free, and there is no upfront service fee. Answer a few questions about your final paycheck to find out whether we can help.

How does the 35% fee work?

Our fee is 35% of the money recovered. You receive 65%. For example, if we recover $2,000, our fee is $700 and you receive $1,300.

What if no money is recovered?

Nothing. You only pay if we recover money for you.

What do I need to do?

Start with a few questions about your last job and when your final paycheck arrived. No documents are needed for that first step. If we can help, we’ll ask for the records needed to review and pursue your claim, and explain what happens next.

Will CheckLate contact my former employer?

Yes, if your claim is accepted and you authorize us to proceed. We handle employer communications and negotiation within the agreed service. Simply checking whether you qualify does not contact your employer.

Can you help if I’ve already received my paycheck?

That is what CheckLate focuses on: final paychecks that arrived late. Getting paid does not necessarily cancel a waiting-time penalty that has already built up. We review the dates and circumstances to see whether we can help.
